Enforcement of Intellectual Property Rights – New Directive


At the end of April 2004, the Commission and Parliament adopted Directive 2004/84 on the enforcement of intellectual property rights. The Directive notes that disparities between the systems of the Member States as regards the enforcing of intellectual property rights are prejudicial to the proper functioning of the internal market and make it impossible to ensure intellectual property rights enjoy an equivalent level of protection throughout the community. The objective of the Directive is to approximate legislative systems so as to ensure a high equivalent and homogenous level of protection in the internal market. A consultation document is expected shortly from the Patent Office on the Directive.
